Regulations relating to the Grading, Packing and Marking of Sorghum Products intended for sale in the Republic of South Africa : effective 30 May 2026

1. Definitions

Unless the context otherwise indicates, any word or expression in these regulations to which a meaning has been assigned in the act shall have that meaning, and—

 

"address"

means a physical address which includes the street or road name, number, and the name of the town, village, or suburb and in case of a farm, the name or number of the farm and of the magisterial district in which it is situated;

 

"bag"

means a container made from suitable material used for transporting or storing of sorghum products;

 

"bulk container"

means, any vehicle or container in which bulk quantities of sorghum product is stored or transported;

 

"bulk probe"

means a double-tube probe of suitable length with multiple apertures on the one side thereof or other similar bulk probe which is suitable for taking a sample of a sorghum product kept in bulk, by means of probing;

 

"consignment"

means a quantity of sorghum products of the same kind or grade which is delivered at any one time under cover of the same consignment note, delivery note or receipt note, or delivered by the same container or if such a quantity is subdivided into different classes, each quantity of each of the different classes;

 

"container"

means an immediate bag or an immediate bulk container or other suitable immediate packing unit or immediate container in which sorghum products are packed and presented for sale;

 

''foreign matter"

in relation to sorghum products, means any material which does not naturally form part of sorghum grain/kernel, but excludes constituents added to enhance the product's nutritional and/or sensory characteristics (speciality products);

 

"grits"

means the product obtained by coarsely grinding the sorghum grain;

 

"insect"

means any live insect which is injurious to grain and milled products, irrespective of the stage of development of the insect;

 

"inspector"

means the Executive Officer or an officer under his or her control, or an assignee or suitably qualified employee of an assignee;

 

"meal"

means the product obtained by the grinding and sifting process of sorghum grain/kernel;

 

"milling"

is a process through which the seed coat is removed, the germ is removed to some extent, and the remaining endosperm/bran/germ is comminated or ground down to a suitable degree of fineness:

 

"pearled (decorticated) grain sorghum"

means the sorghum grain with the bran partially or completely removed;

 

"pre-cooked sorghum meal"

means a sorghum product defined in terms of its cooking properties using words, expressions, references, particulars, or indications such as, but not limited to "par-cooked, quick-cook, and instant";

 

"retail quantities"

means a quantity of 50 kg or less of sorghum product;

 

"sieve"

means a utensil with a woven mesh bottom or perforated metal, constructed from a suitable rigid material used for separating material of varying granulation (grit gauze or wire)) square or round sieve {hand, rotary and automatic sieves) and for which the various sieve sizes meet the requirement set out in Table 2 of Regulation 11;

 

"sorghum"

means the threshed, ripe seeds of the plant of Sorghum bicolor (L) Moench but exclude broom sorghum, hay sorghum and cane sorghum;

 

"sorghum bran"

means a product obtained from the milling of sorghum consisting of mainly of the outer layer of sorghum grain/kernel;

 

"sorghum product"

means a commodity derived from the milling of sorghum grain/kernel (with or without the addition of other ingredients) and which includes enriched, and pre-cooked sorghum meal;

 

"speciality sorghum product"

means products which are derived from the sorghum grains with unique properties providing specific sensory characteristics and/or functional and/or nutritional quality;

 

"the Act"

means the Agricultural Product Standards Act, 1990 (Act No. 119 of 1990); and

 

"unspecified sorghum product"

means a sorghum product which in form or texture is similar to any of the mentioned products but which does not comply with the requirements of any of the grades as prescribed in this regulation.
